Burn Atlas Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Burn Atlas website and application located at burnatlas.org ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By creating an account, subscribing, or otherwise accessing the Service, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and accept these Terms in full. Burn Atlas is operated by an individual sole proprietor doing business as Burn Atlas ("we," "us," or "our"). If you have questions about the legal entity, please contact us at will@burnatlas.org.
2. Description of Service
Burn Atlas is an informational web application designed to assist landowners, land managers, agricultural operators, and burn practitioners in planning prescribed and controlled burns across the United States. The Service provides:
- Real-time weather data and multi-day forecasts for a user-specified location
- Fire danger ratings and Air Quality Index (AQI) data sourced from third-party providers
- Burn ban status information by state and county
- State-specific regulations, permit requirements, and agency contact information
- "Best day to burn" recommendations based on aggregated weather and fire danger data
3. IMPORTANT SAFETY DISCLAIMER — PLEASE READ CAREFULLY
THE SERVICE IS PROVIDED FOR INFORMATIONAL AND PLANNING PURPOSES ONLY. NOTHING IN THE SERVICE CONSTITUTES PROFESSIONAL FIRE MANAGEMENT ADVICE, AND NOTHING SHOULD BE INTERPRETED AS A RECOMMENDATION, AUTHORIZATION, OR PERMIT TO CONDUCT ANY BURN.
Before conducting any controlled or prescribed burn, you must:
- Verify current burn ban status directly with your local, county, and state fire management authorities
- Obtain all required burn permits from the appropriate state or local agency
- Consult with a certified prescribed burn professional or your state forestry agency
- Notify your local fire department as required by local ordinance
- Conduct a site-specific risk assessment and prepare a written burn plan
- Ensure adequate personnel, equipment, and contingency plans are in place before ignition
Weather conditions, burn ban status, fire danger ratings, and regulatory requirements change frequently and without notice. Data displayed in Burn Atlas may be delayed, inaccurate, or incomplete. You are solely and exclusively responsible for verifying all conditions and information before taking any action related to burning.
4. Accuracy of Data and Third-Party Sources
4.1 Third-Party Data Providers
Burn Atlas relies on third-party data providers including, but not limited to, NOAA and the U.S. Environmental Protection Agency's AirNow service. We do not control these data sources and make no warranties regarding their accuracy, timeliness, completeness, or fitness for any particular purpose.
4.2 Burn Ban and Regulatory Information
Burn ban status and regulatory information displayed in the Service is provided for general reference only. Many jurisdictions do not maintain publicly accessible real-time data feeds for burn bans, and information displayed may not reflect current on-the-ground conditions. Always verify burn ban status directly with your state forestry agency, local fire marshal, or county emergency management office before burning.
4.3 No Guarantee of Accuracy
We make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of any information provided through the Service for any purpose whatsoever.
5. User Accounts and Access
5.1 Account Registration
Access to the full features of Burn Atlas requires a paid monthly subscription. You agree to provide accurate and complete registration information and to keep this information current. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5.2 Access Keys
If you are provided a personal access key, that key is for your individual use only and may not be shared, transferred, sold, or otherwise distributed. Unauthorized sharing of access credentials may result in immediate termination of your account without refund.
5.3 Account Security
You agree to notify us immediately at will@burnatlas.org if you become aware of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.
6. Subscriptions, Payment, and Refunds
6.1 Monthly Subscription
Access to the full Burn Atlas Service requires payment of a monthly subscription fee as displayed on the site at the time of purchase. Your subscription will automatically renew each month unless you cancel before the renewal date. All fees are stated in U.S. dollars.
6.2 Cancellation
You may cancel your monthly subscription at any time through your account settings or by contacting us at will@burnatlas.org. Cancellation will take effect at the end of your current billing period. You will retain access to the Service through the end of the paid period.
6.3 Payment Processing
Payments are processed through Stripe, a third-party payment processor. Your payment information is transmitted directly to and stored by Stripe in accordance with their privacy policy and PCI-DSS security standards. Burn Atlas does not store your full credit card details on our servers.
6.4 Refund Policy
Refunds are considered on a case-by-case basis at our sole discretion. If you believe you are entitled to a refund due to a technical issue, billing error, or other circumstance, please contact us at will@burnatlas.org with a description of your situation. We will review your request and respond in a reasonable timeframe. Submitting a refund request does not guarantee that a refund will be issued.
6.5 Price Changes
We reserve the right to change subscription pricing at any time. We will provide reasonable advance notice of any price increase, and continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.
6.6 Taxes
You are responsible for any applicable taxes, levies, or duties associated with your subscription, excluding taxes based on our net income.
7. Permitted and Prohibited Uses
7.1 Permitted Uses
Burn Atlas is intended for use by individual landowners, agricultural operators, land managers, and burn practitioners for the purpose of planning prescribed and controlled burns on land they own, manage, or have explicit authority to burn. Questions about commercial use (e.g., professional burn contractors using the Service on behalf of clients) should be directed to will@burnatlas.org, as commercial licensing terms are addressed on a case-by-case basis.
7.2 Prohibited Uses
You agree not to use the Service to:
- Violate any applicable federal, state, or local law or regulation, including conducting any burn without proper permits or in violation of any burn ban
- Attempt to reverse engineer, scrape, or systematically extract data or content from the Service
- Circumvent any paywall, access control, or security measure
- Share, resell, or redistribute your account access, access keys, or Service content without written authorization
- Provide false or misleading information during registration or use of the Service
- Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure
8. Intellectual Property
All content, design, code, text, graphics, data compilations, and functionality of Burn Atlas are owned by or licensed to the operator and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal burn planning purposes in accordance with these Terms. Nothing in these Terms grants you any right to reproduce, distribute, modify, create derivative works from, or commercially exploit the Service or its content.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BURN ATLAS AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING BUT NOT LIMITED TO:
- Property damage, personal injury, or death resulting from a burn conducted based on information from the Service
- Losses resulting from inaccurate weather, fire danger rating, or burn ban data
- Fines, penalties, citations, or legal liability arising from burns conducted in violation of applicable law
- Wildfire spread or escape from a prescribed burn
- Loss of data, revenue, crops, livestock, or profits
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT YOU PAID TO BURN ATLAS IN THE THREE (3) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify, defend, and hold harmless Burn Atlas and its operator from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) any burn you conduct, whether or not based on information from the Service; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your violation of the rights of any third party.
11. Disclaimers of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND. BURN ATLAS EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
12. Modifications to the Service and Terms
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without liability. We may also update these Terms from time to time. Material changes will be communicated by updating the effective date of this document and, where practicable, by notice within the Service or via the email address associated with your account. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall first be addressed through good-faith negotiation between the parties. If not resolved informally within 30 days, disputes shall be submitted to binding arbitration conducted in Georgia in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
14. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the Service will immediately cease, and no refund will be issued for any remaining subscription period unless required by law. Provisions of these Terms that by their nature should survive termination — including Sections 8, 9, 10, 11, and 13 — shall survive.
15. Advertising
Burn Atlas may display advertisements served by third-party advertising networks, including Google AdSense. These third parties may use cookies and similar tracking technologies to serve ads based on your prior visits to this and other websites. We are not responsible for the content of third-party advertisements. You may opt out of personalized advertising through your browser or device settings.
16. Privacy
Your use of Burn Atlas is also governed by our Privacy Policy, available at burnatlas.org, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein. We collect location data (ZIP code) and usage data to provide the Service and may share aggregated, anonymized data with third-party providers as described in our Privacy Policy.
17. Miscellaneous
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Burn Atlas with respect to the Service and supersede all prior agreements and understandings.
17.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17.3 No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
17.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
