Burning Wheat and Corn Stubble: Rules and Best Practices by Region
Whether burning corn or wheat stubble needs a permit, a phone call, or nothing at all depends entirely on which regulatory model your state uses. Here are the three models, what each one requires, and what the agronomy says about the cost.
Ask three farmers in three states what it takes to burn corn stubble and you'll get three answers that all sound authoritative, because all three are correct.
In eastern Washington it takes a permit application, a Best Management Practices form, a per-acre fee, and a phone call to check the daily burn decision. In Kansas it takes a call to the local fire authority — and in some counties, not even that. In Ohio it's generally allowed on the property where the residue was generated, but not between 6 a.m. and 6 p.m. in October or November, and not within 1,000 feet of a neighbor's house.
None of these are edge cases. They're three genuinely different regulatory models, and the one that applies to you is decided by state air quality law, not by what your neighbor across the county line does.
Quick answer:
There is no national rule for burning crop residue. Whether you need a permit depends on which of three state models applies: a permitted air-quality program, a conditional exemption, or a general allowance with setbacks.
Pacific Northwest states run permit programs. Washington requires an agricultural burn permit for post-harvest field and cereal grain stubble, charges by the acre, and issues a daily burn decision you must check before lighting. Idaho requires registration, grower training every five years, and a $2-per-acre fee.
Great Plains states often exempt ag burning conditionally. Kansas exempts crop residue burning from its open burning prohibition — but only if you notify the local fire authority, avoid traffic and airport hazards, and supervise the fire until it's out.
Midwest states typically allow it with setbacks and seasonal hour limits. Ohio allows agricultural waste burning on the property where it was generated, more than 1,000 feet from any inhabited neighboring building, with all open burning banned 6 a.m.–6 p.m. in October and November.
Local rules stack on top of state rules everywhere, and emergency bans override permits entirely.
The agronomic cost is real and quantifiable. Extension research puts nutrient loss from a well-burned 200 bu/acre corn crop at $25–80 per acre, with 90–100% of residue carbon lost to the atmosphere.
Model 1: the permitted air-quality program (Pacific Northwest)
If you farm in Washington, Idaho, or Oregon, stubble burning is administered as an air quality activity, not a fire activity — and that changes everything about the paperwork.
Washington's Department of Ecology issues permits for commercial agricultural burning and makes daily burn decisions for each county and zone. The permit types are specific: a field permit covers crop residue and cereal grain stubble — wheat, barley, corn, and oats — after harvest. Separate permits exist for piles, spots of half an acre or less, baled residue, and Conservation Reserve Program ground. Fees run $37.50 for the first 10 acres of field burning plus $3.75 per additional acre.
Two details catch newcomers. First, applying isn't the same as being approved: Ecology's Best Management Practices documents are part of the application, and a decision usually takes about seven business days after payment or submittal. Second, holding a permit doesn't authorize burning on any given day — you still have to check the daily burn decision by phone or email subscription before you light. Ecology's list of what doesn't need a permit is worth memorizing too: fence rows, ditch banks, irrigation canals, annual orchard prunings, and windblown tumbleweeds. Everything else needs one.
Idaho DEQ's Crop Residue Burning program works similarly with its own quirks. A crop residue burn permit is required above one acre per day; a spot and bale permit covers areas under an acre and broken bales under two tons per day, capped at 10 acres per year. Growers must register fields, complete online training every five years, and file post-burn reports through a grower portal. Fees run $2 per acre burned, invoiced at year end, for the main permit and a flat $20 for spot and bale. Weekend and holiday burning is allowed under the spot and bale and propane flaming permits but not under the main crop residue permit. DEQ also screens approved burns so smoke doesn't reach institutions with sensitive populations — public schools in session, hospitals, and residential health care facilities.
One caveat on both states, and it's a live one. On the day this article was fact-checked, Washington was under a statewide emergency burn ban through September 30, 2026 under a governor's proclamation, and Idaho DEQ had an active air quality advisory prohibiting all burning in Clearwater and Idaho counties. Model 2: the conditional exemption (Great Plains)
Kansas takes the opposite structural approach and it's easy to misread as "no rules."
Under K.A.R. 28-19-645, open burning of essentially anything is prohibited statewide. But K.A.R. 28-19-648 then carves out agricultural burning: burning grass, woody species, crop residue, and other dry plant growth for crop, range, pasture, wildlife, or watershed management is exempt from that prohibition — provided four conditions are met.
Those conditions are the actual rule, and they're short enough to quote in full:
Notify the local fire control authority with jurisdiction before burning begins, unless the local governing body has adopted a policy that notification isn't required.
Don't create a traffic safety hazard. If smoke may blow toward a public roadway, notify the highway patrol, sheriff's office, or appropriate traffic control authority beforehand.
Don't create an airport safety hazard. If smoke may affect airport visibility, notify the airport authority beforehand.
Supervise the burn until the fire is extinguished.
The regulation closes with a line that matters more than the exemption itself: nothing in it restricts local jurisdictions from adopting more restrictive ordinances. Several Kansas counties prohibit open burning during April outright, with carve-outs for range and pasture management and CRP burning — which is why "it's exempt in Kansas" is a risky thing to tell a neighbor without checking the county.
Worth noting for contrast: Kansas's non-agricultural approval track (K.A.R. 28-19-647) spells out weather conditions the state considers safe — no burning below 5 mph or above 15 mph surface wind, none on days with more than 0.7 cloud cover and a ceiling under 2,000 feet, none started at night. Those aren't binding on the ag exemption, but they're a fair read on what the state's air program considers defensible weather, and they track what mixing height does to smoke.
Model 3: general allowance with setbacks (Midwest)
Ohio is the clearest example of the third model, where crop residue burning is broadly legal but hedged with distance and timing rules.
Per OSU Extension's agricultural law program, Ohio law allows burning "agricultural wastes" — waste generated by crop, horticultural, or livestock production practices, including crop residue and landscape wastes from agricultural activities. What's excluded is just as important: buildings and building materials, garbage, dead animals, animal waste, vehicles and parts, and anything made from petroleum or containing plastic, rubber, grease, or asphalt.
The location rules do most of the work:
Agricultural waste must be burned on the property where it was generated. Hauling it elsewhere, or accepting a neighbor's residue to burn, is illegal.
The burn must be more than 1,000 feet from any neighboring inhabited building.
Burning inside a "restricted area" — inside city or village limits, within 1,000 feet of a village of 1,000–10,000 people, or within one mile of a city over 10,000 — requires ten days' prior written notice to Ohio EPA.
A pile larger than 20 feet wide by 10 feet high (4,000 cubic feet) requires permission from Ohio EPA.
Then the seasonal layer: Ohio prohibits all open burning from 6 a.m. to 6 p.m. during October and November, when fire risk peaks and volunteer departments are thinnest. OSU Extension's earlier guidance notes the same daytime prohibition applies in March, April, and May, with a farmer exception for burning in a plowed field or garden at least 200 feet from woodland, brush land, or dry grass. If you can't meet that buffer, wait until after 6 p.m.
Enforcement isn't theoretical. Ohio EPA can fine up to $1,000 per day per offense, and wildfire-prevention violations can bring third-degree misdemeanor charges carrying up to $500 and 60 days. OSU's list of the most common farmer violations is instructive: burning non-agricultural materials like tires and plastics, missing the 1,000-foot setback, and burning waste hauled in from another property.
What the agronomy says the burn actually costs
Regulatory permission isn't the same as agronomic wisdom, and the extension literature on residue burning is notably unenthusiastic.
Soil fertility specialists at the University of Arkansas System Division of Agriculture put numbers on it. Burning can drive off as much as 100% of the nitrogen and sulfur held in crop residue as gas. Phosphorus, potassium, and zinc aren't volatilized, but they concentrate in ash, and 35–45% can leave the field with wind or runoff. For a 200 bu/acre corn crop producing roughly 5.6 tons of stover per acre, they estimate potential nutrient loss at $25–80 per acre; an 80 bu/acre wheat crop runs $10–30. Carbon loss is the bigger long-term item — 90–100% of residue carbon goes to the atmosphere, drawing down soil organic matter and with it water-holding capacity, structure, and nutrient retention.
The picture isn't one-sided. Arkansas acknowledges real benefits: faster field turnaround and earlier planting dates, which raise yields for corn and rice; reduced residue-borne pathogens; and, in continuous rice systems, escape from rice residue's allelopathic effect on the following crop.
University of Nebraska-Lincoln CropWatch corrects a common assumption: research from Wisconsin and from USDA-ARS in Nebraska found no need to automatically replace nitrogen for the immediately following crop after residue was burned or removed, partly because removing residue shifts the C:N ratio and increases nitrogen mineralization. The larger losses, CropWatch argues, are soil moisture and erosion protection. Kansas research they cite found leaving residue in place saved 3.5 inches of soil water — which in dryland corn could translate to roughly 42 bushels per acre. UNL also documents a yield consequence: after a 2022 wildfire near Arapahoe, Nebraska, following-year grain sorghum yielded 144 bu/acre in unburned zones versus 84 in burned ones, attributed largely to crusted soil shedding rainfall.
Best practices that travel across every region
Regardless of which model governs your ground, four things hold:
Confirm the layer above and below the state rule. Every one of these programs defers somewhere: Washington routes many counties to local clean air agencies, Kansas explicitly preserves stricter local ordinances, Ohio's guidance tells you to call your fire department. Treat the daily decision as separate from the permit. In permit states this is formal. In exemption states it's on you — the same judgment call, just unenforced.
Plan the smoke, not just the fire. Where the plume goes is the variable that turns a legal burn into a complaint, an accident, or a violation. Kansas requires roadway and airport notification only when smoke may drift that way, but the burn where smoke crossed a highway is exactly the burn nobody expected to. Do I need a permit to burn corn stubble?
It depends entirely on your state's model. In Washington and Idaho, yes — post-harvest field and cereal grain stubble requires an agricultural burn permit, plus a daily burn decision check in Washington and registration, training, and post-burn reporting in Idaho. In Kansas, no permit, but you must notify your local fire control authority unless the local governing body has waived that. Is burning wheat stubble treated differently from corn stubble?
Usually not, legally. Washington's field permit covers wheat, barley, corn, and oats together; Kansas's exemption covers "crop residue" without species distinction. The practical differences are agronomic — wheat residue is lighter and lower in nutrient value per acre than corn stover, so Arkansas extension puts nutrient loss from an 80 bu/acre wheat crop at $10–30 per acre versus $25–80 for a 200 bu/acre corn crop.
When is the best time of year to burn crop residue?
Where the season isn't dictated by regulation, it's dictated by fire risk and field logistics. Ohio's daytime burning prohibition in March, April, May, October, and November signals which months carry the most escape risk in that climate, and OSU's own advice under drought conditions is to wait for winter.
